AXE NATION WEBSITE AND SERVICE BOOKING TERMS AND CONDITIONS
§1. General Provisions
These Terms and Conditions set out the rules for using the Axe Nation website, the rules for booking services offered by the Organiser, the conditions for concluding distance contracts, the rules for participating in the activities offered, as well as the rights and obligations of Customers and the Organiser.

b) booking visits, events and additional services,
c) contacting the Organiser,
d) purchasing vouchers, if such option is available on the Website.
These Terms and Conditions are made available free of charge on the Organiser’s website in a manner that allows them to be read, downloaded and stored.
The Customer is obliged to read these Terms and Conditions before making a Booking or using the Organiser’s Services.
§2. Definitions
For the purposes of these Terms and Conditions, the following terms shall have the meanings set out below:
Organiser – the owner of Axe Nation providing the Services covered by these Terms and Conditions.
Website – the Axe Nation website.
Customer – a natural person, legal person or organisational unit making a Booking or using the Organiser’s offer.
Consumer – a natural person performing a legal act with the Organiser that is not directly related to their business or professional activity.
Entrepreneur – a natural person, legal person or organisational unit making a Booking in connection with their business or professional activity.
Service – a recreational, entertainment or event service offered by the Organiser, in particular an axe throwing session, a group event, a corporate event, a bachelor party, a bachelorette party, or any other service indicated in the offer.
Booking – a request to use a Service on a specified date and time.
Participant – a person taking part in the Service.
Venue – the Axe Nation premises where the Service is provided.
Deposit – an amount paid by the Customer towards the Booking, on the terms specified in these Terms and Conditions or in individual arrangements with the Organiser.
Voucher – a document, code or any other form of confirmation entitling the holder to use a Service under the conditions specified by the Organiser.
§3. Conditions of Using the Website
In order to use the Website, it is necessary to have a device with internet access and an up-to-date web browser.
The Customer is obliged to use the Website in a manner consistent with the law, good practice and these Terms and Conditions.
The following is prohibited:
a) providing unlawful content,
b) taking actions that may disrupt the functioning of the Website,
c) impersonating other persons,
d) providing false data when making a Booking.
§4. Type and Scope of Services
The Organiser provides recreational and entertainment Services consisting of organising axe throwing activities and related services, in accordance with the current offer published on the Website or presented individually to the Customer.
The scope of the Service, its duration, the number of Participants, the price and any additional services are each time specified in the offer, the Service description, an e-mail message, the booking form, or in individual arrangements with the Customer.
The Organiser reserves the right to refuse to provide a Service if its performance would be contrary to the law, safety rules, or if the Participants do not meet the conditions for participation.
§5. Booking of Services and Conclusion of the Contract
Bookings may be made:
a) through the form available on the Website,
b) by e-mail,
c) by telephone,
d) through a messaging app or any other channel indicated by the Organiser.
A condition for making a Booking is that the Customer provides true and accurate data necessary for its completion.
A contract shall be deemed concluded once the Customer has made a Booking and the Organiser has accepted and confirmed it.
The Organiser confirms the Booking by e-mail, by telephone, through a messaging app, or in any other agreed manner.
For Bookings for which the Organiser requires payment of a Deposit, maintaining the Booking is conditional upon payment of the Deposit within the deadline indicated by the Organiser.
Failure to pay the Deposit within the specified deadline may result in the cancellation of the Booking or loss of the provisionally reserved time slot.
In the case of group or corporate events, the terms regarding the number of Participants, additional services, payments, catering, bar service, event duration and cancellation rules may be determined individually.
§6. Prices and Payments
All prices provided by the Organiser are expressed in Polish zloty (PLN) and are gross prices, unless expressly stated otherwise.
The Customer may make payment using the methods indicated on the Website or individually agreed with the Organiser.
The Organiser may require payment of a Deposit in order to secure the Booking.
In justified cases, the Organiser may allow payment of the full value of the Service before its performance.
The Organiser issues a sales document in accordance with applicable law.
If a given Booking involves additional costs, in particular relating to additional Participants, catering, bar service, extension of the event duration or other additional services, the Customer shall be informed of them before the contract is concluded. An entrepreneur concluding a distance contract with a consumer should provide the required information in a clear and comprehensible manner no later than at the moment the consumer expresses their intention to conclude the contract.
§7. Change of Date, Cancellation of Booking and Failure to Attend
The Customer may request a change of the Booking date by contacting the Organiser.
A change of the Booking date is possible once only, subject to the availability of free time slots offered by the Organiser.
For Bookings secured by a Deposit, the paid Deposit is non-refundable.
For Bookings paid in full, the payment made is non-refundable.
Cancellation of a Booking by the Customer is possible no later than 24 hours before the planned date of the Service.
In the event of cancellation made in accordance with section 5 above:
a) if the Booking was not secured by a Deposit or advance payment, the Organiser shall not claim payment,
b) if a Deposit was paid towards the Booking, the Deposit shall not be refunded,
c) if the Booking was paid in full, the paid amount shall not be refunded.
After the deadline indicated in section 5 above, the Organiser may, at its own discretion and depending on availability, allow a one-time change of the Booking date, but is not obliged to do so.
Failure of the Customer or Participants to attend the booked time without prior contact with the Organiser shall be treated as failure to use the booked Service for reasons attributable to the Customer.
In the case of corporate Bookings, private events, group events or Bookings made by entrepreneurs, in the absence of prior contact and in the event of failure to attend a confirmed Booking, the Organiser reserves the right to claim payment for the booked Service if it had previously been ordered and confirmed.
In the case of private events, corporate events, large group Bookings or services involving additional benefits, in particular catering, open bar or individual service, the Organiser may apply individual rules regarding change of date, cancellation and settlement, as specified in the offer, e-mail correspondence or Booking confirmation.
If the Organiser is unable to provide the Service for reasons attributable to the Organiser, the Customer shall be offered a new date, a Voucher of the same value, or a refund of the payment made.
§8. Right of Withdrawal from the Contract
As a general rule, a Consumer concluding a distance contract has the right to withdraw from the contract within 14 days, unless an exception provided for by law applies.
The Services offered by Axe Nation are recreational, entertainment or leisure-related services provided on a specified day or within a specified period.
In the case of contracts concerning Services provided on a specific date, the Consumer shall not have the right to withdraw from a distance contract, in accordance with the exception provided for services related to leisure, entertainment or sports events where the contract specifies the date or period of performance of the Service. This is also confirmed by UOKiK.
The above does not exclude the Customer’s rights arising from legal provisions in the event of non-performance or improper performance of the contract by the Organiser.
§9. Vouchers
The Organiser may offer value Vouchers or Vouchers for specific Services.
A Voucher may be used only within its validity period and in accordance with the rules specified by the Organiser.
Redeeming a Voucher may require prior Booking of a date.
A Voucher cannot be exchanged for cash unless mandatory provisions of law provide otherwise.
If a Voucher is not used within its validity period, it shall expire unless its terms provide otherwise.
Detailed rules for the use of Vouchers may be specified in separate Voucher terms and conditions.
§10. Conditions of Participation and Safety
Participation in the Service requires compliance with the safety rules applicable at the Venue as well as with the instructions of the instructors and the Organiser’s staff.
The Organiser has the right to refuse participation in the Service or to interrupt a Participant’s participation if:
a) the Participant is under the influence of alcohol, narcotic drugs or other substances that may affect their fitness or ability,
b) the Participant behaves in an aggressive, dangerous or disruptive manner,
c) the Participant violates safety rules,
d) the Participant’s further participation could pose a threat to themselves or to others.
In the case described in section 2 above, the Customer shall not be entitled to a refund for the unused part of the Service if the refusal of participation or exclusion resulted from reasons attributable to the Participant.
Participants are obliged to use the equipment in accordance with its intended purpose, the instructions of the staff and the safety rules applicable at the Venue.
Minors may participate in the Service only under the rules specified by the Organiser.
The Organiser may specify detailed safety rules in separate safety regulations applicable at the Venue.
§11. Liability
The Organiser shall be liable for the performance of the Service in accordance with the concluded contract.
The Organiser shall not be liable for damage resulting from:
a) the Customer providing false information,
b) failure by the Customer or Participants to comply with these Terms and Conditions or safety rules,
c) force majeure,
d) circumstances attributable to the Customer or Participants.
The Customer shall be liable for damage caused by themselves or by Participants reported by them, in particular for destruction of the Venue’s equipment or fixtures caused intentionally or through gross negligence.
The Organiser shall not be liable for items left unattended at the Venue unless such liability results from mandatory provisions of law.
§12. Complaints
The Customer has the right to submit a complaint concerning the operation of the Website, the Booking process or the performance of the Service.
Complaints may be submitted:
a) by e-mail to: wspolpraca@axenation.com.pl,
b) in writing to the Organiser’s registered address.
A complaint should include:
a) the Customer’s details,
b) a description of the problem,
c) the Customer’s request,
d) data allowing identification of the Booking or purchase.
The Organiser shall consider the complaint within 14 days from the date of its receipt, unless applicable law provides for a different deadline.
§13. Personal Data
The controller of Customers’ personal data is the Organiser.
Personal data is processed for the purpose of:
a) performing Bookings and concluded contracts,
b) handling payments,
c) contacting the Customer,
d) handling complaints,
e) fulfilling legal obligations incumbent on the Organiser.
Detailed rules regarding the processing of personal data are set out in the Privacy Policy available on the Website.
§14. Intellectual Property
All content published on the Website, in particular names, descriptions, photographs, graphics, visual identity elements and marketing materials, is the property of the Organiser or is used by the Organiser in accordance with the law.
Copying, distributing or otherwise using such content without the Organiser’s consent is prohibited unless applicable law provides otherwise.
§15. Final Provisions
These Terms and Conditions are made available free of charge on the Organiser’s website in a manner that allows them to be read, downloaded and stored.
The Organiser reserves the right to amend these Terms and Conditions for important reasons, in particular in the event of changes in law, changes in the scope or manner of providing the Services, or changes in the functionality of the Website.
Bookings made before an amendment to these Terms and Conditions shall be governed by the provisions applicable on the date the contract was concluded.
In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code and the Act on Consumer Rights.
In accordance with art. 13 section 1 and paragraph 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. Axe Nation Karolina Kruk, ul. Grodzka 46, 31-044 Kraków as your Personal Data Administrator, informs that:
- Your data will be processed on the basis of art. 6 clause 1 point a) and point b) and in accordance with the content of the general regulation on the protection of personal data of April 27, 2016.
- Your data will be processed for the purpose of providing services by Axe Nation Karolina Kruk and preparing a quote for the needs of the service and the implementation of the service (including after-sales marketing).
- Your data will be stored during the term of the contract / cooperation with the company and also after its termination for a maximum of 5 years.
- Providing data is voluntary, but necessary to provide services by Ax Nation Karolina Kruk.
- Your data will be made available to persons authorized in connection with their performance of official duties. In accordance with applicable law, we will also share your data with relevant state authorities.
- You have the right to access your data and the right to rectify, delete, limit processing, the right to transfer data, the right to object, the right to withdraw consent at any time without affecting the lawfulness of processing.
- You have the right to lodge a complaint to the supervisory body of the Inspector General for Personal Data Protection (address: General Inspectorate for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw), if you consider that the processing of your personal data violates the provisions of the General Protection Regulation personal data from April 27, 2016.
- Your data will not be processed in an automated manner, including in the form of profiling.
- All notifications and inquiries regarding your personal data should be sent to the above address by post.
